    Se analiza la Ley de Amnistía de 1977, sus antecedentes, contexto, ámbito de aplicación -con referencias a la amnistía laboral y a la cuestión de los militares de la Unión Militar Democrática-, requisitos para su efectiva aplicación y efectos jurídicos que ha producido. Se descartan algunas interpretaciones erróneas que le atribuyen la impunidad de los más graves crímenes de la Guerra Civil y de los primeros años del franquismo. Se señalan como causas de esa impunidad la prescripción y la irretroactividad, con análisis de las resoluciones más recientes en la materia de varias Audiencias, Tribunal Supremo y Tribunal Constitucional, referidas, entre otros, a los casos de bebés robados, caso Garzón y caso Gerardo Iglesias. Se concluye con unas reflexiones sobre la Ley de Memoria Democrática.

    This paper analyses the 1977 Amnesty Law, its background, context and scope of application - with references to the labour amnesty and the question of the military members of the Democratic Military Union -, the requirements for its effective application and the legal effects it has produced. Some erroneous interpretations are discarded, which attribute impunity to the most serious crimes of the Civil War and the early years of Franco's regime. The causes of this impunity are identified as statute of limitations and non-retroactivity, with an analysis of the most recent rulings on the subject by various Courts, the Supreme Court and the Constitutional Court, referring, among others, to the cases of stolen babies, the Garzón case and the Gerardo Iglesias case. It concludes with some reflections on the Law of Democratic Memory.
