Resumen de Desconexión digital: diagnóstico y desafíos para su regulación e implementación en el sector privado

El presente artículo tiene por objetivos: i) evaluar los alcances de la regulación del derecho a la desconexión digital y ii) analizar la implementación de políticas institucionales en el sector privado en torno al derecho a la desconexión digital. En tal sentido, la investigación es de corte correlacional explicativa y de revisión bibliográfica, obteniendo que a nivel internacional el empleador tiene un papel garantista de los derechos de los trabajadores. Sin embargo, en el Perú, no se ha establecido lineamientos para la implementación de políticas institucionales del derecho a la desconexión digital en las empresas privadas. Por este motivo, en el presente trabajo de investigación se abordará los desafíos para la implementación del derecho a la desconexión digital, en el marco del derecho al descanso laboral y la salud de los trabajadores.

The present article has for objetives: i) evaluate the scopes of the regulation of the right to digital disconnection and ii) analyze the implementation of institutional policies in the private sector regarding the right to digital disconnection. In this sense, the research is correlational explanatory and bibliographic review, obtaining that at the international level the employer has a guaranteeing role for workers’ rights. However, in Peru the guidelines for the implementation have not been established of politicies for the right to digital disconnection in private companies. For this reason, this research work will address the challenges for the implementation of the right to digital disconnection, within the framework of the right to rest from work and the health of workers.
