Resumen de Derechos privados y potestades públicas en el ámbito de los cementerios cubanos. Una mirada desde la reforma constitucional actual

El artículo se propone analizar los preceptos implementados en la nueva Carta Magna, trascendentes al régimen de los cementerios públicos. En su metodología se utilizaron los métodos: histórico- lógico, que enfocó el tratamiento jurídico de los cementerios públicos en Cuba y el inductivo- deductivo, que ilustró los fenómenos jurídicos trascendentes a los derechos privados y potestades públicas en el ámbito de los cementerios, consagrados en la nueva Constitución. Como resultado se ofrece un diagnóstico de la precaria regulación cementerial cubana y la necesidad de una ley de cementerios. El estudio se limita al tratamiento constitucional de las formas de propiedad y sus puntos de encuentros con el régimen cementerial. La investigación presenta originalidad y valor, al abordar un aspecto nunca antes analizado desde la dinámica jurídica cubana. Como conclusión, se expresan los aspectos que en el orden constitucional deben ser valorados en la instrumentación de una ley de cementerios en Cuba.

This article intends to analyze the precepts implemented in the new Great Letter, transcendent to the régime of the public cemeteries. In their methodology the methods were used: historical-logical that focused the juridical treatment of the public cemeteries in Cuba and the inductive-deductive one that it illustrated the transcendent juridical phenomena to the private rights and public imperious in the environment of the cemeteries, consecrated in the new Constitution. As a result offers a diagnosis of the precarious Cuban regulation`s cemeteries and the necessity of a law. The study is limited to the constitutional treatment in the ways of property and its points of encounters with the régime´s cemeteries. The investigation presents originality and value, when never approaching before an aspect analyzed from the Cuban artificial dynamics. As conclusion, the aspects are expressed that should be valued in the instrumentation of a law of cemeteries in Cuba in the constitutional order.
