    El conocimiento y uso adecuado del lenguaje supone una herramienta clave para lograr la integración de la población inmigrante en la sociedad a través de políticas públicas integrales, que abarcan también a la administración de justicia. Los retos lingüísticos que afloran en el sistema judicial son variados, y no sólo afectan a aspectos jurisdiccionales, como pueda ser el curso de los procedimientos en su vertiente adjetiva, sino también al fondo de los asuntos en su vertiente sustantiva. Por un lado, los retos lingüísticos procesales se refieren fundamentalmente al ejercicio del derecho fundamental a la tutela judicial efectiva, a través del derecho al uso de traductor o intérprete en los distintos procedimientos judiciales, que en ocasiones tienen su origen en procedimientos administrativos previos. Por otro lado, los retos lingüísticos sustantivos tiene que ver con múltiples aspectos, tantos como aspectos tiene la integración del inmigrante en la vida social española. tales como la concesión de la nacionalidad, el ejercicio de derechos laborales, derechos y deberes electorales, costumbres y tradiciones del país de origen, comisión de ilícitos penales, y otros muchos. Tanto los primeros como los segundos inciden directamente en el grado de consecución de los derechos fundamentales y en consecuencia de los derechos humanos de los inmigrantes en nuestro país y por ende en la Unión Europea.

    The knowledge and proper use of language is a key tool to achieve the integration of the immigrant population in society through comprehensive public policies, which also cover the administration of justice. The linguistic challenges that arise in the judicial system are varied, and not only affect jurisdictional aspects, such as the course of proceedings in their adjective aspect, but also the substance of the issues in their substantive aspect. On the one hand, the procedural linguistic challenges basically refer to the exercise of the fundamental right to effective judicial protection, through the right to use a translator or interpreter in the different judicial proceedings, which sometimes originate from previous administrative procedures. On the other hand, the substantive linguistic challenges have to do with multiple aspects, as many as aspects of the immigrant's integration into Spanish social life, such as the granting of nationality, the exercise of labor rights, electoral rights and duties, customs and traditions of the country of origin, commission of criminal offences, and many others. Both the first and the second directly affect the degree of achievement of fundamental rights and consequently the human rights of immigrants in our country and therefore in the European Union.
