El presente estudio ofrece una construcción coherente del derecho a la libertad de cátedra, que se separa en ocasiones de las posiciones mantenidas por el Tribunal Constitucional español en la materia. Analiza, en particular, las injerencias que pueden producirse en el derecho fundamental provocadas por las propias estructuras de las universidades públicas. Finalmente, valora negativamente la incidencia que tendrá en la libertad de cátedra la aprobación de la Ley Orgánica del Sistema Universitario (LOSU) y de otras reformas en curso que afectan a las Universidades.
This study offers a coherent construction of the right to academic freedom, which sometimes departs from the positions held by the Spanish Constitutional Court on the subject. In particular, it analyses the interference that can occur in the fundamental right caused by the very structures of public universities. Finally, it negatively assesses the impact that the approval of the Organic Law of the University System (LOSU) and other reforms in progress affecting universities will have on academic freedom.
