    La competencia de las Instituciones de la Curia Romana puede examinarse desde una perspectiva material para evaluar la legitimidad y la incidencia de las funciones que les asigna la Constitución Apostólica Praedicate Evangelium del papa Francisco. La contribución se centra en los límites “externos” de la competencia material, que implican las relaciones entre la Iglesia y las realidades temporales, así como en los límites “internos” que derivan de la necesidad de salvaguardar bienes jurídicos eclesiales específicos (como la unitas fidei y los derechos de los fieles), previendo un remedio que podría favorecer en la Iglesia sinodal la revisión de las normas destinadas a definir las atribuciones y prerrogativas de las estructuras superiores de gobierno.

    The competence of the institutions of the Roman Curia can be examined from a material point of view to evaluate the legitimacy and impact of the functions assigned to them by the Apostolic Constitution Praedicate Evangelium of Pope Francis. The contribution focuses on the “external” limits of material competence, which involve the relationships between the Church and temporal realities as well as on the “internal” limits which derive from the need to safeguard specific ecclesial juridical assets (such as the unitas fidei and the rights of the faithful), proposing a remedy to encourage the revision of the norms in the synodal Church that define the attributions and prerogatives of the apical structures of government.
