En la ordenación territorial y urbanística concurren una dicotomía administrativa-civil y otra judicial-administrativa. Y ello, entre otras cosas, porque no cabe transformar el suelo o actuar sobre las edificaciones sin afectar a la propiedad, lo que extiende, a su vez, las consecuencias a la publicidad del Registro de la Propiedad y porque las funciones públicas informan los contratos privados. En este marco se desenvuelven con especial complejidad los procedimientos para dar cumplimiento a las decisiones judiciales civiles que recaen sobre fincas o derechos sometidos a un proceso de ejecución del Plan o para garantizar que pueda ejecutarse el fallo a través de situaciones cautelares.

n urban planning there is both an administrative-civil dichotomy and another judicial-administrative dichotomy. And this, among other things, is because it is not possible to transform the land or act on the buildings without affecting the property, which extends, in turn, the consequences to the publicity of the Land Registry and because the public functions inform the private contracts. Within this framework, procedures are developed with special complexity to comply with civil judicial decisions that fall on properties or rights subject to a process of execution of the Plan or to guarantee that the judgment can be executed through precautionary situations.
