  INTRODUCCIÓN. El presente trabajo analiza como el homicidio culposo por mala práctica médica en el Ecuador afecta a los servidores de la salud. OBJETIVO. Se ha realizado una investigación y análisis en torno al homicidio culposo por mala práctica médica, sus elementos, como se configura y su regulación para poder establecer el impacto que genera en la sociedad y como la normativa contrarresta este delito. Para realizar este trabajo, se analizará los conocimientos adquiridos mediante consultas, documentos bibliográficos y fuentes digitales. MÉTODO. La investigación realizada es de carácter exploratoria y descriptiva, debido a que se utilizaron diversos métodos, como el investigativo y analítico, que han sido empleados para argumentar la transcendencia del homicidio culposo por mala práctica médica. DISCUSIÓN Y CONCLUSIONES. Se llega a la conclusión que esta acción, no posee una normativa acorde a las necesidades que se encuentran involucradas en este tipo de delito y son estos vacíos lo que afectan gravemente a los derechos de los médicos.

  INTRODUCTION. This paper analyzes how wrongful death due to medical malpractice in Ecuador affects health care workers. OBJECTIVE. An investigation and analysis has been carried out on the negligent homicide by medical malpractice, its elements, how it is configured and its regulation in order to establish the impact it generates in society and how the regulations counteract this crime. In order to carry out this work, the knowledge acquired through consultations, bibliographic documents and digital sources will be analyzed. METHOD. The research carried out is exploratory and descriptive in nature, due to the fact that various methods were used, such as investigative and analytical, which have been used to argue the transcendence of culpable homicide due to medical malpractice. DISCUSSION AND CONCLUSIONS. It is concluded that this action does not have a regulation according to the needs that are involved in this type of crime and it is these gaps that seriously affect the rights of physicians.
