The paper analyzes the Dobbs judgment of 2022 on the right to abortion of the US Supreme Court, both in its contents and in its consequences in terms of recognition of the fundamental rights of the person in the United States of America. By observing the ways in which the us legal system has evolved in recent decades, including in the field of abortion rights, the paper takes into consideration the technical reasons that allowed the overruling of Roe v. Wade. It also analyzes the position of the European Union, expressed by the European Parliament, on the issue. Finally, the possible repercussions of the Dobbs sentence are foreseen with regard to the legal treatment of the right to abortion, and with regard, more broadly, to the protection of the fundamental rights of the person in the United States system.
