  • The paper intends to underline the pertinence and usefulness of a reading of Dobbs from the perspective of «law and religion». Then it dwells on the radical nature of the choice of deconstitutionalization of the right to abortion made by the Court and on the instrumental use of the originalist argument, in the union that it establishes with the reductive interpretation of constitutional rights and freedoms and with the alleged neutrality of the Federal Constitution. The intention is to focus on the placement of the religious factor in the context of the dialectic between conservation and innovation that characterizes the dynamics of implementation-updating of constitutional ends-values.
