The «Opera di Santa Croce» is one of the oldest «fabbricerie» which since the 14th century has dealt with the safeguarding, promotion, and enhancement of Santa Croce Monumental Complex under an agreement with the owners («Fondo Edifici di Culto» of the Italian Home Office and the Municipality of Florence). This essay contains some remarks on the Council of State’s judgment No. 7742 of 6th September 2022, according to which these ecclesiastical entities cannot qualify as public law bodies («organismi di diritto pubblico») and therefore are not, as such, bound to respect the public procurement rules.
