El presente trabajo tiene como objetivo analizar la justicia penal restaurativa en México desde la óptica de los derechos humanos y de la axiología jurídica, analizando la teoría del contrato social, las teorías del abolicionismo penal y la filosofía de la cultura de paz que han incidido en la formación ontológica de nuestro sistema jurídico mexicano en su proceso de transición del modelo retributivo al paradigma restaurativo penal de naturaleza inminentemente garantista.

The present work aims to analyze restorative criminal justice in Mexico from the point of view of Human Rights and Legal Axiology, analyzing the theory of the social contract, the theories of criminal abolitionism and the philosophy of the culture of peace that have influenced the ontological formation of our Mexican legal system in its process of transition from the retributive model to the restorative criminal paradigm of an imminently guaranteed nature.
