Derecho a indemnización por los daños y perjuicios causados por un tratamiento de datos en infracción del RGPD, tras la STJ de 4 de mayo de 2023

    El Tribunal de Justicia ha dictado una sentencia, de fecha 4 de mayo de 2023, abordando la interpretación del artículo 82 del Reglamento General de Protección de Datos (RGPD), donde declara que la mera infracción del RGPD en cuanto al tratamiento de datos personales no fundamenta un derecho a indemnización. En cambio, para que exista un derecho a indemnización no es necesario que los daños y perjuicios inmateriales sufridos hayan alcanzado cierto umbral o grado de gravedad mínimo. Por último, también se analiza el papel de las normas nacionales de los Estados miembros que deben complementar las lagunas del artículo 82 del RGPD, en particular, con respecto a la cuantificación de los daños.

    The Court of Justice has issued a judgment, dated 4 May 2023, addressing the interpretation of Article 82 of the General Data Protection Regulation (GDPR), in which it states that the mere infringement of the GDPR with regard to the processing of personal data does not establish a right to compensation. On the other hand, for there to be a right to compensation, it is not necessary for the non pecuniary damage suffered to have reached a certain minimum threshold or degree of severity. Finally, the role of Member States’ national rules that should complement the loopholes of Article 82 of the GDPR, in particular with regard to the quantification of damages, is also analysed.
