Una breve historia sobre la (im)prescriptibilidad penal

    Resumen El objetivo principal de este artículo es demostrar que la prescripción penal es una institución de corta data y más bien de excepción. Por ello, se exponen los sistemas que han reconocido en el tiempo la capacidad de extinguir la responsabilidad penal, desde el derecho griego hasta la actualidad, centrándose en los sistemas de derecho continental y en el Common Law. Se concluirá que la prescripción penal no es una institución asentada en todos los ordenamientos y, mayoritariamente, en aquellos que se reconoció convivió con la imprescriptibilidad para delitos atroces, tendencia que ha resurgido por la incidencia del derecho internacional de los derechos humanos en los ordenamientos internos.

    Abstract The main objective of this paper is to demonstrate that criminal Statutes of Limitations is a short-term institution, in the main legal systems, and rather an exception. For this reason, the systems that have recognized over time the ability to extinguish criminal liability are presented, from Greek Law to the present, focusing on Continental Law Systems and Common Law. It will be concluded that the criminal Statutes of Limitations is not an institution established in all the legal systems and, for the most part, in those that were recognized it coexisted with the Non Statutes of Limitations for atrocious crimes, a trend that has re-emerged due to the incidence of International Human Rights Law in the legal systems internal.
