Teletrabajo en la Función Pública: Ley y negociación colectiva

    En el presente trabajo, se analiza el régimen jurídico del teletrabajo en el ámbito de la función pública española, lo que requiere de un estudio tanto en la Administración General del Estado como en las Administraciones de las Comunidades Autónomas. A tal fin, se parte del RDLey 29/2020, de 29 de septiembre, de medidas urgentes en materia de teletrabajo en las Administraciones Públicas y de recursos humanos en el Sistema Nacional de Salud, para hacer frente a la crisis sanitaria ocasionada por la COVID-19; y se llega al RDLey 29/2020, en virtud de cuyo art. 1 se ha introducido el art. 47 bis Real Decreto Legislativo 5/2015, de 30 de octubre, por el que se aprueba el texto refundido de la Ley del Estatuto Básico del Empleado Público (en adelante, EBEP), como marco normativo básico en materia de teletrabajo para todas las Administraciones Públicas -que deben adaptar al mismo sus propias regulaciones- junto con las normas autonómicas al respecto.

    Además, este estudio se detiene en analizar cuál es el papel de la negociación colectiva en la regulación del teletrabajo en el seno de las Administraciones Públicas.

    In this work, the legal regime of teleworking in the field of the Spanish public service is analyzed, which requires a study both in the General Administration of the State and in the Administrations of the Autonomous Communities. To this end, it is based on RDLaw 29/2020, of September 29, on urgent measures regarding teleworking in Public Administrations and human resources in the National Health System, to face the health crisis caused by COVID -19 and we arrive at RDLaw 29/2020, by virtue of which art. 1 art. 47 bis Royal Legislative Decree 5/2015, of October 30, which approves the consolidated text of the Law of the Basic Statute of Public Employees (onwards, EBEP), as a basic regulatory framework on teleworking for all Public Administrations - which must adapt their own regulations- together with the regional regulations in this regard. Furthermore, this work stops at analyzing the role of collective bargaining in the regulation of teleworking within Public Administrations.
