La atipicidad penal del cultivo y/o comercialización del cannabis no psicoactivo

    El boom del cannabidiol o CBD (uno de los principales componentes del cannabis) ha supuesto un importante resurgimiento comercial del cultivo y comercialización del cáñamo industrial o, mejor expresado, del cannabis no psicoactivo, es decir, que no produce los efectos propios de las drogas. Así, cada vez son más frecuentes la venta de cremas, aceites, geles, etc., hechos a base de CBD. Pero, también se comercializa en forma de productos alimenticios (infusiones, chocolate, etc.), como cigarrillos electrónicos o, directamente, se vende la propia flor de cáñamo o «cogollo» sin efecto psicoactivo para uso decorativo o coleccionismo y, en algunos países, como producto herbal para fumar. En España no existe una clara posición legal frente al cultivo destinado a la comercialización de flores de CBD. En este trabajo se defiende la tesis de que cualquier cultivo y/o comercialización de cannabis que no tenga componente psicoactivo debe considerarse atípico y, por tanto, exento de responsabilidad penal.

    The boom in cannabidiol or CBD (one of the main components of cannabis) has led to a significant commercial resurgence in the cultivation and marketing of industrial hemp or, better expressed, non-psychoactive cannabis, that is, one that does not produce the effects of drugs. Thus, the sale of creams, oils, gels, etc., made from CBD, is becoming more frequent. But, it is also marketed in the form of food products (infusions, chocolate, etc.), as electronic cigarettes or, directly, the hemp flower itself or «bud» is sold without psychoactive effect for decorative use or collecting and, in some countries , as a herbal product for smoking. In Spain there is no legal position against the cultivation intended for the commercialization of CBD flowers. This paper defends the thesis that any cultivation and/or commercialization of cannabis that does not have a psychoactive component should be considered atypical and, therefore, exempt from criminal liability.
