Desde el año 2000, en España, se ha dado cobertura legal al uso de la mediación en materia de justicia juvenil, aunque la ley solo ampara la posibilidad de intervención en la fase de instrucción y no posteriormente. El Estatuto de la Víctima de 2015 introduce en derecho español el concepto de justicia restaurativa, que pasa a incorporarse de forma definitiva, en el actual anteproyecto de Ley de Enjuiciamiento Criminal (LECr) publicado en 2021. La finalidad que persigue la justicia restaurativa puede conseguirse recurriendo a cualquiera de sus herramientas, siendo la mediación la más sencilla y conocida por la ciudadanía. Sin embargo, si la LECr sale adelante, se legitima el uso de otras herramientas como los círculos o las sentencias, de tal forma que, si va a ser posible usarlas en el ámbito de los adultos, con más razón, dado el efecto educativo y reparador que produce, debe reconocerse y admitirse también en justicia juvenil. Por este motivo, una vez aprobada la nueva ley procesal penal, será necesario modificar la regulación de menores para darle cabida.

Since the year 2000, in Spain, legal coverage has been given to the use of mediation in matters of juvenile justice, although the law only protects the possibility of intervention in the investigation phase and not later. The 2015 Crime Victim Statute introduces the concept of restorative justice into Spanish law, which is now incorporated definitively into the current preliminary draft of the Criminal Procedure Law (LECr) published in 2021. However, if the LECr goes ahead, the use of other tools such as circles or sentences will be legitimized, in such a way that, if it is going to be possible to use them in the field of adults, all the more reason, given the educational and repairer that produces, must be recognized and admitted also in juvenile justice. For this reason, once the new criminal procedure law is approved, it will be necessary to modify the regulation of minors to accommodate it.
