    The respect for the Constitution is a constant concern for lawmakers in France, either prior to or during the discussion in Parliament. Based on the experiences of a minister and of an administrator of the French National Assembly, the article tries to assess the burden of the Constitution of the Fifth Republic on each of those who contribute to the writing of the law. As a revered reference, the Constitution imposes a judicial constraint on a process that remains highly political. The whole question then rests on the proper articulation between two poles—the law and politics—that may either merge or be in contradiction.

    Le respect de la Constitution est une préoccupation permanente lorsqu’on écrit la loi, tant en amont de la discussion au Parlement que pendant celle-ci. À partir de deux expériences, celle d’une ministre et celle d’un administrateur de l’Assemblée nationale, on mesure le poids que la Constitution fait peser sur chaque acteur qui contribue à la confection de la loi. Référence qui suscite la révérence, la Constitution impose une contrainte juridique dans un processus qui reste éminemment politique. Tout est alors question d’articulation entre ces deux pôles – le droit et la politique – qui peuvent soit se rejoindre, soit entrer en contradiction.
