  En una sorprendente e interesante sentencia, el TJUE pone en cuestión la interpretación que se había venido haciendo del art. 10 del Reglamento (CE) 2201/2003 y de su relación con el proceso de restitución en un supuesto de traslado ilícito de menores. El mecanismo de prevalencia se ve alterado en la medida que considera que es posible que el órgano jurisdiccional del Estado miembro en que los menores tenían su residencia habitual antes del traslado puedan hacer uso del art. 15 y remitir el conocimiento del asunto al Estado miembro al que han sido ilícitamente trasladados, si consideran que ello está justificado en razón del interés superior de los menores.

  In a surprising and interesting judgment, the CJEU calls into question the interpretation that had been made of Article 10 of Regulation (EC) 2201/2003 and its relationship with the return proceedings in a case of wrongful removal of children. The mechanism of prevalence is altered insofar as it considers that it is possible for the court of the Member State in which the children were resident prior to the transfer to make use of Article 15 and refer the case to the Member State to which they have been wrongfully removed if they consider that this is justified on the grounds of the best interests of the children.
