El constructivismo pedagógico aplicado al derecho: hacia una formación dinámica

    La formación jurídica debe corresponder a la dinámica social. El conocimiento de la inteligencia a través de la neurociencia nos orienta en el sentido de considerar que la formación debe corresponder ahora a las múltiples inteligencias humanas: intelectual, emocional, intuitiva, social, ecológica, cosmológica. El conductismo jurídico puso en el profesor el monopolio del saber y lo impuso a los estudiantes; el constructivismo jurídico, por su parte, pone énfasis en el estudiante como constructor de su propio conocimiento, por lo cual se propone como síntesis, siguiendo a Philippe Not, que ambos accedan a la producción de ideas trabajando de manera conjunta. Este conocimiento pro-ducto del diálogo responsable, democrático, en las aulas, hará que se reproduzca en nuestra sociedad una democracia política.

    The legal formation must correspond to social dynamics. The knowledge of intelligence through orients us to the neuroscience in the sense to consider that the formation must correspond now to multiple human intelligences: emotional, intuitive, social, ecological, cosmological intellectual. The legal behaviorism put in the professor the monopoly of the knowledge and it imposed the students; the legal constructivism on the other hand, puts emphasis in the student like constructor of its own knowledge, thus sets out like synthesis, following Philippe Not, hat both accede to the production of ideas working of joint way. This knowledge product of the responsible, democratic dialogue, in the classrooms, will cause that a political democracy reproduces in our society.
