Hacia un nuevo modelo de justicia

    Este estudio de reflexión teórica pretende, tras un análisis de la realidad actual, sugerir algunas ideas y recomendaciones que ayuden a aclarar varias confusiones que, en nuestra opinión, parecen estar impidiendo la fluida introducción del uso de la mediación, como método alternativo de resolución de conflictos, en nuestro país. Del mismo modo se destacará la existencia de algunos obstáculos que están dificultando una cómoda y rápida normalización de la mediación, entre la población. Comenzando por una descripción del contexto actual en materia de justicia, se realizarán algunas propuestas que colaboren al logro de una ordenación práctica del uso de la mediación en la actualidad, terminando por definir el nuevo modelo de administración relacional hacia el que se está dirigiendo nuestra realidad social. Dadas las ventajas que el proceso de mediación legal puede aportar a nuestra nueva, modernizada y pragmática sociedad, se finalizará ofreciendo unas consideraciones finales hacia las que hoy día se presenta muy necesario trabajar, para poder lograr una seria transformación en el sistema actual de justicia.

    This study, as a theoretical reflexión intends, while analising the actual situation that we are living in our days, give some advise and suggestions in order to help clarifying some confusions that seem to stop a fluid incorporation of the use of mediation, as an alternative method of resolution, in our country. At the same time it will stand out the existence of some obstacles that are making difficult a confortable and fast normalization of mediation among the population. Starting with a description of the actual context in relation with justice, we will make some proposals to collaborate with the achievement of a practical arrangement of the use of mediation currently, finishing with the definition of the new relational management operating model, where our society is heading towards. Given all the advantages that the legal mediation model can give to our new, modern and pragmatical society, we will finish contributing with some final considerations, that we think is really necessary to work with, in our days, in order to achieve a serious transformation in the actual justice systmem.
