Complexidade, direito e a necessidade de (re)integração da espécie humana a Gaia

    A temática ambiental, transcende as fronteiras sociais criadas pela espécie humana, ao mesmo tempo em que se encontra perfeitamente interligada à sobrevivência dessa na Terra. Tal fato atrelado a complexidade social contemporânea norteia a proposta do presente estudo, que objetiva analisar a possibilidade da espécie humana se (re)integrar ao planeta Terra, a fim de evitar um colapso futuro de ambas. Nessa esteira, pretende-se responder a seguinte problemática com no presente artigo: é possível ao ser humano, diante da alta complexidade social em que se encontra inserido contemporaneamente, regressar a um estado semelhante ao de suas origens, no que diz respeito a comunicação com o Meio Ambiente, com intuito de salvaguardar a existência do planeta Terra, em si, bem como da(s) espécie(s) (humana) que se encontram inseridas, qual o papel do sistema do Direito, nessa implexa relação. Para tanto, utilizar-se-á como teoria base para realização da presente pesquisa a Teoria dos Sistemas Sociais Autopoiéticos, de Niklas Luhman, acompanhado do método indutivo de pesquisa, bem como a revisão de bibliografias nacionais e internacionais, com intuito de se chegar a uma resposta ao problema, esperando-se, assim encontrar meios de se mostrar ser possível (re)aproximação da espécie humana a Gaia, o que propiciaria uma melhora das condições dessa, bem como da subsistência da espécie humana.

    The environmental theme transcends the social boundaries created by the human species, at the same time that it is perfectly intertwined with its survival on Earth. This fact, linked to contemporary social complexity, guides the proposal of the present study, which aims to analyze the possibility of the human species if (re) integrate to the planet Earth, in order to avoid a future collapse of both. In this vein, it is intended to answer the following problem with the present article: it is possible for the human being, given the high social complexity in which he is inserted contemporaneously, to return to a state similar to the one of its origins, as far as the communication with the Environment, in order to safeguard the existence of the planet Earth, as well as the species (s) (human) that are inserted, what is the role of the legal system in this relationship. In order to do so, the theory of the Autopoietic Social Systems of Niklas Luhman, accompanied by the inductive method of research, as well as the revision of national and international bibliographies, will be used as base theory to carry out the present research in order to arrive at a response to the problem, and it is hoped, therefore, to find a means of proving itself to be possible (re) approximation of the human species to Gaia, which would lead to an improvement of the conditions of that species, as well as to the subsistence of the human species.
