Resumen de La legitimación activa del Estado en las garantías jurisdiccionales en el derecho constitucional ecuatoriano

  Ecuador ha establecido garantías jurisdiccionales para salvaguardar los derechos, especialmente frente a posibles abusos en la esfera pública. Una de estas garantías es la acción de protección, que reemplazó al recurso de amparo que rigió hasta el 2008 cuando la Constitución vigente estructuró las garantías. La evolución del derecho constitucional ecuatoriano trajo consigo un gran avance en la protección de los derechos constitucional. Sin embargo, es importante considerar la posibilidad de que se distorsione el alcance de estas garantías y se utilice de manera indebida, razón por la cual, su estudio es fundamental, y el debate de su alcance está siempre en el debate jurídico. En este estudio, abordamos las restricciones del Estado al ser parte demandante en la acción de protección, especialmente en lo que corresponde a los derechos constitucionales de carácter procesal.

  Ecuador has established jurisdictional guarantees to safeguard rights, especially against possible abuses in the public sphere. One of these guarantees is the protection action, which replaced the appeal for protection that was in effect until 2008 when the current Constitution structured the guarantees. The evolution of Ecuadorian constitutional law brought with it a great advance in the protection of constitutional rights. However, it is important to consider the possibility that the scope of these guarantees may be distorted and used improperly, which is why their study is fundamental, and the debate on their scope is always in the legal debate. In this study, we address the restrictions of the State when being a plaintiff in the protection action, especially in what corresponds to constitutional rights of a procedural nature.
