La garantía constitucional de presunción de inocencia: su incidencia e importancia en el desarrollo del procedimiento penal oral acusatorio

    La presunción de inocencia, constituido en aquel derecho constitucional que garantiza al justiciable la posibilidad de acceder a un proceso con sujeción estricto al mandato constitucional y normativo, por medio del cual se garantiza la seguridad jurídica que debe primar en el desarrollo del proceso penal en un Estado Constitucionalmente Democrático. Esta garantía se encuentra presente en el decurso de todo el procedimiento ya sea este administrativo, civil, contravencional y penal por lo cual es considerado como el eje del sistema procesal. Ahora bien, a pesar de constituirse en la columna vertebral del sistema en la práctica procesal, dicha garantía es objeto de laceraciones y quebrantamientos procedimentales, lo cual ha generado nulidades a costas de quienes se encuentran como titulares de la acción penal, así como de quienes se encuentran como garantes por la inobservancia a la hora de acusar o resolver la controversia. Se aplicó una metodología en la cual se recurrió a la revisión científica-analítica, bibliográfica-documental, se aplicó la técnica descriptiva con el diseño no experimental, asistido de los métodos analítico argumentativo e inductivo-deductivo. Para recopilación y sintetización de la información se utilizó la revisión bibliográfica de los aportes científicos y doctrinales de los juristas más destacados en las plataformas tecnológicas. Se ha evidenciado objetivamente que la presunción de inocencia como garantía constitucional, constituye el baluarte del sistema procesal penal ecuatoriano, se concluye que su efectiva y oportuna aplicación garantiza el debido proceso que se ve reflejada en la seguridad jurídica que brinda.

    The presumption of innocence, constituted in that constitutional right that guarantees the defendant the possibility of acceding to a process strictly subject to the constitutional and regulatory mandate, by means of which the legal security that must prevail in the development of the criminal process in a Constitutionally Democratic State. This guarantee is present in the course of the entire procedure, be it administrative, civil, misdemeanor and criminal, which is why it is considered the axis of the procedural system. However, despite constituting the backbone of the system in procedural practice, said guarantee is subject to lacerations and procedural breaches, which has generated annulments at the expense of those who are holders of the criminal action, as well as those who they are found as guarantors for non-compliance when accusing or resolving the controversy. A methodology was applied in which the scientific-analytical, bibliographicaldocumentary review was used, the descriptive technique was applied with the non-experimental design, assisted by the analytical-argumentative and inductive-deductive methods. For the compilation and synthesis of the information, the bibliographic review of the scientific and doctrinal contributions of the most outstanding jurists in the technological platforms was used. It has been objectively evidenced that the presumption of innocence as a constitutional guarantee constitutes the bulwark of the Ecuadorian criminal procedure system, it is concluded that its effective and timely application guarantees due process that is reflected in the legal security it provides.
