Resumen de Descripción de la crítica penal al concepto de culpabilidad funcional de Günher Jakobs

Este artículo contrasta el concepto de culpabilidad funcional propuesto por Günther Jakobs con algunas ideas críticas esbozadas por la dogmática mayoritaria con el interés de señalar los posibles efectos negativos que este representa a la individualización judicial de la pena y a los derechos y garantías de los procesados. Con base en una descripción documental de los criterios que componen la culpabilidad funcional, así como de las principales observaciones hechas a esta teoría, mediante los cuales los distintos autores advierten sobre los riesgos de fusionar el injusto con la culpabilidad y el castigo, se concluye que abandonar al autor del delito para centrarse en reforzar la fidelidad de la comunidad al derecho, desemboca en una instrumentalización del sujeto que atenta contra la imagen humanizadora de la sanción penal.

This article contrasts the concept of functional culpability proposed by Günther Jakobs with some critical ideas outlined by the majority dogmatics with the interest of pointing out the possible negative effects that it represents to the judicial individualization of punishment and to the rights and guarantees of the accused. Based on a documentary description of the criteria that make up functional culpability, as well as the main observations made to this theory, through which the different authors warn about the risks of merging the unjust with culpability and punishment, it is concluded that abandoning the perpetrator of the crime to focus on reinforcing the community's fidelity to the law, leads to an instrumentalization of the subject that goes against the humanizing image of the criminal sanction.
