    El presente artículo plantea como tema central el análisis de las generalidades de lo referente a la jubilación patronal dentro del derecho, desde el momento en que se alcanzan los requisitos básicos legales que permiten a cada ciudadano acceder e ingresar a dicho beneficio. De esta manera se identificaran las instituciones del derecho laboral, para analizar e identificar la naturaleza jurídica de la jubilación, la cual le permitirá satisfacer sus necesidades básicas y primordiales luego de obtenida la jubilación y retiro. Así pues, se establece como derecho fundamental dentro del marco jurídico de la República del Ecuador el derecho a la jubilación, determinado como un derecho irrenunciable de los trabajadores, así como también a tener seguridad social

    The present article raises as a central theme the analysis of the generalities of what refers to the employer retirement within the law, from the moment in which the basic legal requirements that allow each citizen to access and enter said benefit are reached. This will identify the institutions of labor law, to analyze and identify the legal nature of retirement, which will allow you to meet your basic and primary needs after obtaining retirement and retirement. Thus, the right to retirement is established as a fundamental right within the legal framework of the Republic of Ecuador, determined as an inalienable right of workers, as well as having social security.
