Resumen de Elementos jurídicos que permiten diferenciar el feminicidio del homicidio de mujeres

Con el presente trabajo se pretende clarificar de manera detallada la correcta tipificación del feminicidio, esto ante el elevado aumento de feminicidios a nivel país. De ese modo, el presente estudio tiene por objetivo principal identificar correctamente los elementos que constituyen el tipo penal de feminicidio y nos permitan distinguir del homicidio de mujeres. La metodología utilizada es cualitativa porque se recolecto información expuesta en la propia ley, y se construyó todo el conocimiento sobre el tema desarrollado en base a esa información obtenida, partiéndose de un método inductivo, es decir, conforme a los elementos que constituyen el tipo objetivo y el tipo subjetivo que se descubrieron conforme lo establece la propia ley. No obstante, se verificó que a pesar de que la misma legislación penal establece o delimita los elementos constitutivos del tipo penal de feminicidio, finalmente es la Corte Suprema de Justicia finalmente la que sienta postura respecto al análisis de los casos juzgados como feminicidio.

This work aims to clarify in detail the correct classification of feminicide, given the high increase in feminicides nationwide. Thus, the main objective of this study is to correctly identify the elements that constitute the criminal type of feminicide and allow us to distinguish it from the homicide of women. The methodology used is qualitative because information set out in the law itself was collected, and all the knowledge on the topic developed was built based on that information obtained, starting from an inductive method, that is, in accordance with the elements that constitute the objective type. and the subjective type that were discovered as established by the law itself. However, it was verified that although the same criminal legislation establishes or delimits the constitutive elements of the criminal type of feminicide, it is ultimately the Supreme Court of Justice that takes a position regarding the analysis of cases judged as feminicide.
