El presente trabajo tiene por objeto destacar la trascendencia de la sentencia de la sala Penal de la Corte suprema que, al acoger un recurso de queja, ha establecido que el derecho a defensa comprende el derecho-deber del secreto profesional y que la interceptación, grabación y transcripción del agente judicial de la conversación telefónica del abogado con su cliente y su posterior entrega al fiscal, no estaban cubiertas por el mandato legal, de modo que actuó fuera de la ley.

This paper aims to highlight the significance of the judgment of the Criminal Chamber of the supreme Court accepted an appeal that the complaint has been established that the right to defense includes the right and duty of professional secrecy and that the interception, recording and bailiff transcript of telephone conversation with his lawyer’s client and handed over to the prosecutor, was not covered by the legal mandate, so I act outside the law.
