Resumen de Novos debates sobre as migrações climáticas e sua regulação internacional

   The exponential increasing of human migration during the last decades is caused by the climate change and variability. The present research aims to discuss the terminological divergences about the climate refugees (or climate displaced persons) as well as its relevance to the global legal recognition to this vulnerable category of persons. After the debate concerning the causality between migration and climate change, it is important to discuss the question about the international environmental legislation on climate refugees. Considering the terms of the research, the conclusion argues that the Refugee Statute (1951) and its Protocol (1967) provide an expansive interpretation of the concept of refugee in order to encompass the climate refugee. The methodology adopted for the present research is bibliographical, characterized by deductive, qualitative and theoretical instruments.

  As migrações humanas induzidas pela mudança e variabilidade climática têm aumentado exponencialmente nas últimas décadas. A pesquisa em questão possui a finalidade de arguir as divergências terminológicas acerca dos refugiados (ou deslocados) ambientais, bem como sua importância para um reconhecimento jurídico global, após, discutir o nexo de causalidade entre as referidas migrações com as mudanças climáticas, para então adentrar na discussão sobre a Legislação Ambiental Internacional acerca dos Refugiados Ambientais. Na pesquisa, chegou-se a conclusão que, tanto o Estatuto dos Refugiados (1951) e seu Protocolo (1967) permitem uma interpretação ampliativa do conceito de refugiado de maneira a contemplar o refugiado climático. A metodologia adotada para a presente pesquisa é bibliográfica, caracterizada como dedutiva, qualitativa e teórica.
