A interpretação da reforma trabalhista nas Varas do Trabalho de Belém/PA e os Acordos Coletivos em tempos pandêmicos

    The article investigates the interpretative treatment of points of the Labor Reform, from the perspective of the first degree of jurisdiction, specifically in the city of Belém/PA, at the Regional Labor Court of the 8th Region (TRT8). The study was authorized by the Ethics Committee, under CAAE nº 22472919.1.0000.0018, and approved by the PIBIC/UFPA. In continuity, it was observed the way telework was used in times of the Covid-19 pandemic, from the Collective Agreements signed between the Union of Teachers (SINPRO/PA) and the Union of Teaching Establishments in Belém/PA (SINEPE/PA). The study used empirical research, using a qualitative approach and the inductive method. Points of the Reform were described, a semi-structured questionnaire was applied, and documents were analyzed, specifically the Collective Agreements made by SINPRO/PA and SINEPE/PA, during the pandemic. The results of the research showed that the Labor Reform was received with caution by the judges of the Labor Court, whose decisional pattern will be in accordance with the Constitution and with the International Treaties. Furthermore, it was noted that the occurrence of Covid-19 and its negative impacts forced, at the local level, the union of teachers and educational maintainers with their respective unions, establishing telework as the best way to maintain jobs and educational activities.

    O artigo investiga o tratamento interpretativo de pontos da Reforma Trabalhista, a partir da perspectiva do primeiro grau de jurisdição, especificamente na cidade de Belém/PA, junto ao Tribunal Regional do Trabalho da 8ª Região (TRT8). A realização do estudo foi autorizada por Comitê de Ética, sob o CAAE nº 22472919.1.0000.0018, e aprovada em Edital PIBIC/UFPA. Em continuidade, observou-se a forma de utilização do teletrabalho em tempos de Pandemia da Covid-19, a partir dos Acordos Coletivos firmados entre o Sindicado dos Professores (SINPRO/PA) e o Sindicato dos Estabelecimentos de Ensino em Belém/PA (SINEPE/PA). O estudo utilizou a pesquisa empírica, realizando abordagem qualitativa e servindo-se do método indutivo. Pontos da Reforma foram descritos, questionário semiestruturado foi aplicado e documentos foram analisados, especificamente os Acordos Coletivos realizados pelo SINPRO/PA e SINEPE/PA, durante a Pandemia. Os resultados da pesquisa mostraram que a Reforma Trabalhista foi recepcionada com cautela pelas juízas e juízes do Trabalho, cujo padrão decisional ficará em conformidade com a Constituição e com os Tratados Internacionais. Além disso, constatou-se que a ocorrência da Covid-19 e seus impactos negativos obrigaram, no âmbito local, a união de professores e de mantenedores educacionais aos seus respectivos sindicatos, firmando-se o teletrabalho como a melhor maneira de manter os empregos e as atividades educacionais.
