Esse artigo busca refletir sobre as transformações do acesso à justiça no cenário atual, os reflexos da pandemia COVID-19 e sua relação com o direito ao desenvolvimento. Indaga-se acerca dos desafios para a efetivação desse direito no contexto atual. A pesquisa é exploratória com abordagem qualitativa, partindo da construção do conceito jurídico de desenvolvimento, suas dimensões e positivação no ordenamento jurídico. Conclui-se pela importância da atuação estatal para mitigar os efeitos da crise no acesso à justiça e assegurar esse direito como uma nova vertente ao desenvolvimento.
This article seeks to reflect on the transformations in access to justice nowadays, the reflexes of the COVID-19 pandemic and its relationship with the right to development. It asks about the challenges for the realization of this right in the current context. The research is exploratory with a qualitative approach, starting from the construction of the legal concept of development, its dimensions and positivity in the legal order. It concludes by the importance of state action to mitigate the effects of the crisis on access to justice and to ensure this right as a new aspect of development.
