Resumen de A flexibilização do registro de agrotóivos no Brasil: da revolução verde ao registro técito estabelecido pela Portaria nº 43/2020 do MAPA

  O presente artigo, dividido em três tópico argumentativos, objetiva analisar a Portaria n° 43/2020 do MAPA, bem como os dispositivos legais que possibilitaram a criação do registro tácito de agrotóxicos. A análise visa questionar a compatibilidade constitucional da portaria ministerial. Somado ao aumento do registro de agrotóxicos e ao histórico nacional de utilização desses produtos, observou-se a flexibilização das exigências relacionadas ao registro de agrotóxicos como estratégia de mitigação das normas constitucionais e infraconstitucionais destinas à proteção da saúde e do meio ambiente ecologicamente equilibrado, refletindo numa incompatibilidade constitucional da Portaria n°43/2020 do MAPA. Para construir o texto, partiu-se do método dedutivo e da técnica de pesquisa bibliográfica.

  This article, divided into three argumentative topics, aims to analyze the ministerial regulation n° 43/2020 from MAPA, as well as the legal devices that allowed the creation of tacit registration of pesticides. The considerations focus on questioning the constitutional compatibility of the ministerial ordinance. Added to the increase in the registration of pesticides and the national history of use of these products, the relaxation of the requirements related to the registration of pesticides as a strategy for mitigation of constitutional and legal norms aimed at the protection of health and the balanced environment was observed, reflecting a constitutional incompatibility of MAPA Ordinance n°43/2020. To construct the text, we started from the deductive method and the bibliography research technique.
