    The work aims to present the historical and conceptual evolution of the family based on past and current legislation. The adopted methodology was the bibliographic and legislative revision. Therefore, the importance of affection as a general principle of law and the need for its application in the judiciary are explained. It also lists the obligations arising from the paternal-filial relationship, especially the figure of coexistence and mutual respect as an obligation of the parents and the implications of non-compliance with the duties imposed. The damage caused to the LGBT + youth is demonstrated when he is affectionately abandoned by his parents and the possibility of increasing the expected financial compensation due to discrimination is being studied.

    O trabalho tem como objetivo apresentar a evolução histórica e conceitual da família com base nas legislações pretéritas e atuais. A metodologia adotada foi a de revisão bibliográfica e legislativa. Para tanto, explana-se a importância do afeto como princípio geral de Direito e a necessidade da sua aplicação no judiciário. Enumera-se ainda quais as obrigações advindas da relação paterno-filial, principalmente a figura da convivência e do mútuo respeito como obrigação dos genitores e as implicações do não cumprimento dos deveres impostos. Demonstra-se os danos causados ao jovem LGBT+ quando abandonado afetivamente pelos pais e estuda-se a possibilidade de majorar a indenização pecuniária prevista, decorrente da discriminação.
