Os acordos comerciais regionais no contexto das mudanças do clima

    O objetivo deste artigo é contextualizar a temática dos acordos comerciais regionais em sua relação com o regime climático, especialmente a partir da vigência do Acordo de Paris. Para tanto, pontua-se inicialmente os regimes multilaterais do clima e do comércio, a interação que estabelecem e, em particular, as disposições comerciais que assimilam a proteção ambiental e a configuração do regionalismo; na sequência, são apresentadas as principais características dos acordos comerciais regionais e o papel que desempenham na regulação de temas considerados difíceis ou sensíveis na agenda comercial internacional, como o das mudanças do clima; e, ao final, delineiam-se algumas perspectivas acerca do trato climático pelo comércio regional, o que implica na consideração das políticas climáticas unilaterais dos países contratantes. Assim, com método dedutivo, o emprego de técnicas bibliográficas e documentais, infere-se que os acordos comerciais regionais têm potencial para a experiência e promoção de medidas abrangentes de proteção climática, de modo a contribuir com o desenvolvimento sustentável e influenciar no regramento dos regimes multilaterais do clima e do comércio.

    The aim of this paper is to contextualize the theme of the regional trade agreements in their relationship with the climatic regime, especially since the validity of the Paris Agreement. To this end, the multilateral climate and trade regimes, the interaction which they establish and, in particular, the commercial provisions which assimilate environmental protection and the configuration of regionalism, are initially pointed out; in the sequence, the main features of regional trade agreements and the role they play in regulating issues considered difficult or sensitive in the international trade agenda, such as climate change, are presented; and, in the end, some perspectives on the climate treatment by regional trade are outlined, which implies consideration of the unilateral climatic policies of the contracting countries. Thus, the deductive method, with the use of bibliographic and documentary techniques, it is inferred that regional trade agreements have the potential for the experience and promotion of comprehensive measures of climate protection, in order to contribute to sustainable development and influence the regulation of multilateral regimes of climate and trade.
