    O texto visa à abordagem das relações entre a constituição e o direito ao desenvolvimento. Ao depois de se ressaltar o reconhecimento do direito ao desenvolvimento mediante declarações internacionais de direitos, especialmente a Declaração sobre o Direito ao Desenvolvimento da ONU de 1986, foi delineada uma ideia atual de desenvolvimento, a qual implica transformação. Não obstante o caráter de não exigibilidade imediata da norma da Constituição Federal de 1988 que prevê o direito ao desenvolvimento, é indiscutível a utilidade do diploma constitucional, o que ocorre mediante a previsão de liberdades instrumentais, as quais são indispensáveis para que aquele pode ser alcançado. Ao final, adverte-se que a normatividade da constituição, em casos como tais, dependentes de fatores políticos, sociais e econômicos, encontra-se subordinada ao desafio da realidade.

    The text aims to address the relationship between the constitution and the right to development. By emphasizing the recognition of the right to development by declarations of human rights, especially the 1986 UN Declaration on the Right to Development, a current idea of development was outlined, which implies transformation, so that economic growth must be done with social justice.

    Despite the character of non-immediate enforceability of the 1988 Federal Constitution rule that provides for the right to development, the usefulness of the constitutional law is indisputable, which occurs through the provision of instrumental freedoms, which are indispensable for that to be achieved.

    In the end, it is warned that the normativity of the constitution, in such cases, dependent on political, social and economic factors, is subordinated to the challenge of reality.
