Moradia, propriedade e meio ambiente: a Regularização Fundiária Urbana (REURB) como instrumento de efetivação dos direitos socioambientais

    The purpose of this article is to analyze the Urban Land Regularization Law, n. 13.465 / 2017 (REURB), comparing with the fundamental rights to housing and balanced environment, expressed in art. 6 and 225 of the Constitution of the Federative Republic of Brazil of 1988 (CRFB / 1988). The central objective is to verify whether REURB is an instrument that enforces such fundamental rights. For this purpose, the legal-theoretical method and deductive reasoning with bibliographic research technique were used in this research. The theoretical framework consists of the ideas established in the UN declarations, especially in the 1948 Declaration of Human Rights and the 1966 International Covenant on Economic, Social and Cultural Rights, which recognize that all people must have an adequate standard of living. In the end, it appears that it is possible to implement the fundamental rights to housing and healthy environment using the instruments contained in the REURB properly.

    O objetivo deste artigo é analisar a Lei de Regularização Fundiária Urbana, nº 13.465/2017(REURB), cotejando com os direitos fundamentais  à moradia e ao meio ambiente equilibrado, expressos no art. 6º e 225 da Constituição da República Federativa do Brasil de 1988 (CRFB/1988). O objetivo central é verificar se a REURB é instrumento que efetiva tais direitos fundamentais. Para tanto, foram utilizados na realização desta pesquisa, o método jurídico-teórico e raciocínio dedutivo com técnica de pesquisa bibliográfica. O referencial teórico consiste nas ideias firmadas nas declarações da ONU, especialmente na Declaração dos Direitos humanos de 1948 e no Pacto Internacional dos Direitos Econômicos, Sociais e Culturais  de 1966 que reconhecem que todas as pessoas devem ter um nível adequado de vida. Ao final, verifica-se que é possível efetivar os direitos fundamentais à moradia e ao meio ambiente saudável utilizando adequadamente os instrumentos contidos na REURB.
