    El presente trabajo estudia la realidad ecuatoriana en lo concerniente a la presunción de legitimidad —su relatividad—, el acto administrativo y la clasificación de este último en actos regulares e irregulares. También considera las diferentes posiciones doctrinales frente al acto administrativo manifiestamente viciado y, por último, analiza los diversos cuerpos normativos en los que la Administración fundamenta su actuar. En este sentido, pretende llenar vacíos que la normativa no explica y, de esta forma, limitar el espectro de aplicación de la presunción de legitimidad para toda clase de actos administrativos.

    This paper studies the Ecuadorian reality regarding the presumption of legitimacy —its relativity— the administrative act and the classification of the latter into regular and irregular acts. It also considers the various doctrinal viewpoints regarding the manifestly flawed administrative act; and lastly, it analyzes the different normative bodies on which the Administration bases its actions. In this sense, its aim is to cover the gaps that the norm does not explain, and thus limit the spectrum of application of the presumption of legitimacy in all types of administrative acts.
