Resumen de Análisis del sistema penal juvenil en la legislación de Ecuador y el nuevo paradigma de justicia restaurativa

  El presente artículo de investigación se centra en la importancia de regular la Justicia Restaurativa en el Sistema Penal juvenil de Ecuador, con sus diferentes programas y sus beneficios, para lo cual se utilizarán los métodos científico, analítico y hermenéutico. Se ha planteado regular el nuevo paradigma de la Justicia Restaurativa desde los estándares internacionales e indicar cuáles son las formas de terminación anticipada en la legislación de Ecuador como enfoque restaurativo en la justicia penal juvenil, de igual forma se recurrirá al derecho comparado de la legislación de México y Perú, para demostrar que al tener regulada la justicia restaurativa en el sistema penal juvenil, guiará a los operadores de justicia para un proceso imparcial, especializado y encaminado a la resocialización y reeducación de las y los adolescentes en contacto con el sistema penal, así como la reparación del daño causado a la víctima, garantizando de esta manera los Derechos Humanos de las partes intervinientes.

  This research article focuses on the importance of regulating Restorative Justice in the Juvenile Penal System of Ecuador, with its different programs and its benefits, for which scientific, analytical and hermeneutical methods will be used. It has been proposed to regulate the new paradigm of Restorative Justice from international standards and indicate what are the forms of early termination in the Ecuadorian legislation as a restorative approach in juvenile criminal justice, in the same way the comparative law of the legislation of Mexico and Peru, to demonstrate that by having restorative justice regulated in the juvenile penal system, it will guide justice operators for an impartial, specialized process aimed at the resocialization and re-education of adolescents in contact with the penal system, as well as the repair of the damage caused to the victim, thus guaranteeing the Human Rights of the parties involved.
