    Los Smart Contracts han ganado relevancia en el contexto del auge de la tecnología blockchain, pero existe la posibilidad de adoptar un enfoque tecnológicamente neutral hacia esta nueva forma de automatización contractual. Hasta ahora, solo la Comisión de Derecho del Reino Unido ha llevado a cabo un análisis exhaustivo sobre su adecuación legal dentro de la ley contractual, dando origen a los Smart Legal Contracts. Este estudio se basa en dicho informe y realiza una comparativa entre los requisitos para la formación de contratos en el derecho inglés y español. Su objetivo es analizar si es posible alcanzar la misma conclusión en nuestra legislación: que el derecho contractual español está preparado para admitir esta forma de contratación. En última instancia, se busca determinar si los Smart Legal Contracts pueden ser plenamente reconocidos y ejecutados en el marco legal español, asegurando la seguridad y confiabilidad de las transacciones realizadas mediante esta innovadora tecnología.

    Smart Contracts have gained prominence in the context of the rise of blockchain technology, but there is the possibility of adopting a technology-neutral approach towards this new form of contractual automation. So far, only the UK Law Commission has conducted a comprehensive analysis on their legal suitability within contract law, giving rise to Smart Legal Contracts. This study is based on that report and compares the requirements for contract formation in English and Spanish law. Its objective is to analyze whether it is possible to reach the same conclusion in our legislation: that Spanish contract law is prepared to admit this form of contracting. Ultimately, it seeks to determine whether Smart Legal Contracts can be fully recognized and enforced in the Spanish legal framework, ensuring the security and reliability of transactions made through this innovative technology.
