    The red thread that pertains to all the powers recognized to the National Prosecutor also in matters of terrorism in order to check its constitutional integrity, concerns the situation of evidence that underlies the exercise of all the powers-duties of the National Anti-Mafia and Anti-Terrorism Directorate for which, while the action of the investigators coordinated by the same is discretionary and based on probabilistic reasoning, the activity of the National Prosecutor must conform to an exclusive use of formal logic as a basis for judgment and action

    Il filo rosso che attiene a tutti i poteri riconosciuti al Procuratore Nazionale anche in materia di terrorismo al fine di controllarne la tenuta costituzionale, riguarda la situazione di evidenza che è alla base dell’esercizio di tutti i poteri-doveri della Direzione Nazionale Antimafia ed Antiterrorismo per cui, mentre l’azione dei soggetti inquirenti coordinati dalla stessa è discrezionale ed improntata a ragionamenti probabilistici, l’attività del Procuratore Nazionale deve conformarsi ad un esclusivo impiego di logica formale come base di giudizio e di azione
