El ejercicio del derecho de defensa del demandado en un juicio civil se desglosa en cuatro facultades procesales, las que, si bien comparten un mismo fundamento, se distinguen de las cargas procesales en cuanto a los efectos de su incumplimiento en la etapa de discusión del juicio civil declarativo. Este artículo analiza dichas facultades en el marco de las leyes procesales civiles de Chile y Alemania con el objetivo de identificar las condiciones que hacen efectivo el derecho de defensa en un proceso civil y los mecanismos procesales que ha-cen probable la tutela judicial efectiva de la parte demandada.
The exercise of the defendant’s rights of defense in a civil trial is broken down into four procedural prerogatives, which, although sharing the same foundation, are distinguished from procedural charges in terms of the effects of non-compliance in the discussion stage of a declarative civil trial. This article analyzes these prerogatives within the framework of the Chilean and German civil procedural laws to identify the conditions that make the right of defense effective in a civil proceeding and the procedural mechanisms that make effective judicial protection of the defendant probable.
