¿es inconstitucional la prohibición de custodia compartida del artículo 92.7 del código civil?

    El artículo 92.7 del Código Civil prohíbe la custodia compartida cuando alguno de los progenitores está incurso en un proceso penal relacionado con la violencia doméstica. La norma persigue ante todo proteger el interés superior de los menores, que se considera incompatible con aquel supuesto. Sin embargo, en el caso aquí comentado las circunstancias concurrentes indicaban que la custodia compartida era, precisamente, el sistema más adecuado para los hijos menores afectados por la decisión. Teniendo en cuenta que el interés superior del menor es un concepto jurídico indeterminado, llamado a ser concretado por el juez en cada caso particular, así como que la prohibición de la custodia compartida limita el derecho a la vida privada y familiar de los progenitores y los menores, la constitucionalidad del precepto ha sido sometida al Tribunal Constitucional (asunto 4701-2020).

    Article 92.7 Civil Code prescribes the ban on shared parenting when any of the parents is involved in criminal proceedings regarding domestic violence. The aim of the law is to preserve the best interest of the child, which is regarded as incompatible with such a situation. However, in the circumstances of the case here considered shared parenting appeared to be the best decision for the children´s sake. Taking into account that the best interest of the child is an undefined legal concept that must be fulfilled by the judge in the instant case, and considering that the ban on shared custody interferes with the right to respect for private and family life of both parents and children, the decision about the constitutionality of the law has been referred to the Constitutional Court (case 4701-2020)
