  Para decidir cómo actuar (la decisión a tomar consistirá, fundamentalmente, en decidir si debe seguirse adelante o no con el procedimiento judicial o arbitral que la anti‐suit injunction quiere impedir), deberán considerarse varios parámetros; el principal, la verificación de si la parte demandada tiene o no activos fuera de la jurisdicción en la que se ha dictado la anti‐suit injunctions cuya ejecución pueda hacer factible el cobro de una posible resolución condenatoria. También resultará aconsejable obtener la protección de la jurisdicción receptora de la anti‐suit injunctions a través de una orden judicial neutralizadora de aquélla (anti‐anti suit), para poder sostener ante la jurisdicción emisora de la ASI que se actuó en el extranjero con el amparo de la autoridad judicial del foro.

  In order to decide how to act (the decision to be taken will essentially consist of deciding whether or not to go ahead with the judicial or arbitral proceedings that the anti‐suit injunction seeks to prevent), several parameters should be considered; the main one being the verification of whether or not the defendant has assets outside the jurisdiction in which the anti‐suit injunction has been issued whose enforcement may make it feasible to collect a possible condemnatory decision. It will also be advisable to obtain the protection of the jurisdiction receiving the anti‐suit injunctions through an anti‐suit injunction, in order to be able to argue before the jurisdiction issuing the ASI that it acted abroad with the protection of the judicial authority of the forum.
