    La caracterización del denominado arbitrio de tercero (expert determination en la terminología inglesa) plantea cuestiones de gran sutileza que implican algunos de los principios críticos del Derecho contractual. El presente ensayo, a través de la sistemática contraposición de la jurisprudencia española e inglesa, trata de ofrecer una aproximación certera al funcionamiento jurídico de esta figura.

    The characterization of the so‐called expert determination (arbitrio de tercero in Spanish legal terminology) raises questions of great subtlety that involve some of the critical principles of Contract Law. This essay, through the systematic comparison of Spanish and English case law, attempts to offer an accurate approximation to the legal functioning of this figure
