Resumen de Ensino jurídico: os desafios para uma formação crítica

  The objective of the research was to understand the legal education regarding the limits that challenge critical education, based on the experience of the Law Course of a community university located in the state of Santa Catarina, Brazil. Documentary analysis of the Pedagogical Project of the Course (PPC) was carried out, semi-structured interviews with professors and questionnaires were applied to the graduates. The interpretation of the datawas from the perspective of content analysis, with a qualitative approach and in the light of the selected theoretical framework. It was concluded that the PPC privileges critical training but finds limits in its lack of knowledge by teachers and students, in the objectivity of teaching, in the absence of conditions for operationalization, in the norms of higher education and in the positivism of legal science.

  O objetivo da pesquisa foi compreender o ensino jurídico quanto aos limites que desafiam a formação crítica, a partir da experiência do Curso de Direito de uma universidade comunitária localizada no estado de Santa Catarina, no Brasil. Realizou-se a análise documental do Projeto Pedagógico do Curso (PPC), entrevistas semiestruturadas com docentes e aplicação de questionários aos egressos. A interpretação dos dados foi na perspectiva da análise de conteúdo, com abordagem qualitativa e à luz do referencial teórico selecionado. Concluiu-se que o PPC privilegia a formação crítica, mas encontra limites no seu desconhecimento por docentes e discentes, na objetividade do ensino, na ausência de condições para operacionalização, nas normas do ensino superior e no positivismo da ciência jurídica.
