El derecho de guerra durante la Guerra del Pacífico (1879-1884): ¿guerra justa o guerra de conquista?

    La presente investigación tiene como objetivo identificar las opiniones doctrina-les occidentales sobre el derecho de guerra con las que interactuaron juristas sudamericanos para responder al desafío de justificar o deslegitimar la expansión chilena en contexto de Guerra del Pacífico (1879-1884). La reconstrucción del marco de referencia normativo inter-nacional de la época puede contribuir a descifrar el significado local que adquiere el derecho de guerra en el contexto intelectual andino a fines del siglo XIX. Utilizando literatura espe-cializada y documentos histórico-jurídicos, se concluye que la universalización del derecho internacional conllevó a la formulación de discursos locales de justificación de la guerra que respondieron a desafíos institucionales regionales como los conflictos bélicos sudamericanos.

    This research aims to identify Western doctrinal opinions on the law of war with which South American jurists interacted to respond to the challenge of justifying or delegitimizing Chilean expansion in the context of the War of the Pacific (1879-1884). The reconstruction of the international normative frame of reference can contribute to translate the local meaning that the law of war gets in the Andean intellectual context at the end of the 19th century. By means of specialized literature and historical-legal documents, it is con-cluded that the universalization of international law led to the formulation of local discourses of justification of war which responded to regional institutional challenges such as the South American war conflicts.
