El objetivo general de la investigación fue analizar jurídicamente la libre explotación minera, la tutela judicial efectiva, la seguridad jurídica y un ambiente sano. Se apoyó en la perspectiva cuantitativa, de tipo documental-bibliográfica. Esto en vista de que a partir de la revisión documental y el estudio de la realidad social observada se han logrado inferir conclusiones reflexivas por parte de los investigadores, de la problemática planteada. Como técnicas de estudio se empleó el análisis documental de leyes, tesis y análisis de los mismos. Además, se aplicó una encuesta a (100) abogados en libre ejercicio profesional, y a jueces multicompetentes de la Unidad Judicial de Chimbo y Las Naves, Provincia de Bolívar. Se concluye que, la libre explotación minera vulnera el derecho a vivir en un ambiente sano y ecológicamente equilibrado, dados los impactos ambientales que genera toda actividad de explotación de recursos no renovables como la minería.

The general objective of the research was to make a legal analysis of free mining exploitation, effective judicial protection, legal security and a healthy environment. It was based on a quantitative, documentary-bibliographic perspective. This in view of the fact that from the documentary review and the study of the social reality observed, the researchers have been able to infer reflective conclusions about the problems posed. Documentary analysis of laws, theses and their analysis were used as study techniques. In addition, a survey was applied to (100) lawyers in free professional practice, and to multicompetent judges of the Judicial Unit of Chimbo and Las Naves, Province of Bolivar. It is concluded that free mining exploitation violates the right to live in a healthy and ecologically balanced environment, given the environmental impacts generated by any activity of exploitation of non-renewable resources such as mining.
