Resumen de Análise jurídica e jurisprudencial do crime de violência psicológica

  The aim of this study is to analyze psychological violence that manifests itself in family and domestic relationships, specifically against women. Next, the crime of psychological violence against women is discussed, typified in article 147-B of the Penal Code, which criminalized this conduct starting in the year 2021. Through legal bibliographical reviews and examination of relevant legislation, adopting a deductive approach, the intention is to highlight the damage inflicted on victims of this type of violence, exposing how it impacts their health and routine, as well as exploring the legal solutions that exist to protect them. The results obtained through this study showed that psychological violence is a harm that often remains hidden, haunting women's daily lives, despite the inclusion of article 147-B in the Penal Code, because the legal effectiveness of this rule is limited due to a lack of clarity and its application often proves insufficient. Ultimately, it concludes that further research into this issue is essential, with the aim of constantly improving the laws and protection mechanisms that are suitable for tackling and preventing psychological violence.

  No presente estudo, tem-se como objetivo a análise da violência de natureza psicológica que se manifesta nas relações familiares e domésticas, direcionada especificamente às mulheres. A seguir, é discutido o delito de violência psicológica contra mulheres, tipificado no artigo 147-B do Código Penal, o qual criminalizou essa conduta a partir do ano de 2021. Utilizando revisões bibliográficas na área jurídica e consulta às legislações pertinentes, adotando uma abordagem dedutiva, o intuito é destacar os danos infligidos às vítimas desse tipo de violência, expondo de que forma isso impacta sua saúde e rotina, além de explorar as soluções legais existentes para a sua proteção. Os resultados obtidos por meio deste estudo demonstraram que a violência de natureza psicológica é um malefício que muitas vezes permanece oculto, assombrando o cotidiano das mulheres, apesar da inclusão do artigo 147-B no Código Penal, pois a eficácia jurídica dessa norma é limitada devido à falta de clareza e sua aplicação muitas vezes se revela insuficiente. Em última análise, conclui-se que uma investigação mais aprofundada sobre essa temática se faz essencial, com o propósito de aprimorar constantemente as leis e os mecanismos de proteção que são adequados para enfrentar e prevenir a violência psicológica.
