The ecuadorian's Constitution of 2008 was issued with the offer to expand the catalog of constitutional rights. However, its text excludes the dimensions of the human being and replaces the natural person with the State. This paper will study the concepts that Juan Fernando Sellés in order to identify what are the basics of rights in the Ecuadorian Constitution of 2008 and what place the human being occupies in this theoretical debate.

La Constitución ecuatoriana de 2008 se expidió con la oferta de ampliar el catálogo de derechos constitucionales. Sin embargo se excluyen de su texto las dimensiones del ser humano y se sustituye a la persona natural con el Estado. En este trabajo se estudiará las definiciones que plantea Juan Fernando Sellés para identificar cuáles son los fundamentos de los derechos en la Constitución ecuatoriana de 2008 y qué lugar ocupa la persona humana en este debate teórico.
