Resumen
The pendulum of humanitarian intervention and, more generally, of the understanding, analysis and study of the migration phenomenon seems to show that policies in this area, including those of the European Union, are fragile and unstable, much more than they should simply in the name of the founding constitutional and Euro-unitary values. Consequently, there are “pushes” and “counter-pushes” that, on the wave of the aforementioned fragility and uncertainties, have characterized the status of citizen and the concept of citizenship, questioning the anthropological relevance of the person. This article, starting from the analysis of fundamental internal and Community principles, aims to verify in practice, on the basis of a regulatory recognition and an exemplary case law, what “we really are” and what are the policies and interventions that can be “required” on the legal level. In this context, the aim is to highlight the being and must be underlying a problem whose vastness and intersections are particularly numerous
